Facing Prostitution Charges in Philly? You Have Options

Let’s have an honest chat about the messy reality of prostitution charges in Philadelphia. Getting busted is scary — the legal system is cold and confusing, the potential punishments are harsh, and the social judgment cuts deep. As a Philly defense lawyer, I get it. And I’m here to help.

First up, take a breath. You have more options than you realize right now. The prosecutors have to prove guilt beyond reasonable doubt, and skilled defense attorneys know how to poke holes or uncover police mistakes. With some smart legal moves, we can get charges lowered or even dismissed. I’ve done it many times before.

Now, what exactly are you looking at here? The main Philly prostitution offenses include:

  • Promoting Prostitution — basically pimping. This covers anyone who owns, manages, finances, or supervises a house of prostitution or prostitution business.
  • Patronizing a Prostitute — exchanging anything of value for sex acts.
  • Living off Proceeds of Prostitution — knowingly accepting financial support from a person engaged in prostitution.

The penalties vary based on exactly what you’re charged with, along with factors like prior record. But generally we’re talking misdemeanors unless you have three or more priors, in which case they can upgrade to felonies. Trust me, you don’t wanna learn this stuff the hard way from a cell. So let’s talk defense strategy…

Poking Holes in the Prosecution’s Case

If cops totally tricked or entrapped you, we can get the whole case tossed out. But they’re getting sneakier about how they orchestrate undercover stings after getting burned in court before.

Still, an experienced lawyer can spot flaws in how they directed the operation or handled the evidence. Common targets:

Diminished capacity covers situations where you weren’t in your right mind — maybe you were on drugs, mentally ill, intellectually disabled, etc. I once had a judge take pity on a young woman with severe PTSD stemming from past abuse. He ordered probation and counseling instead of jail time.

Another hail mary play is claiming necessity — meaning you had to break the law out of extreme hardship. If selling sex was the only way to afford critical medical treatment or feed your kids, we can make that argument. Juries have been sympathetic in super desperate cases before.

Alternative Resolutions: Diversion Programs, Pleas, Reduced Sentencing

Sometimes winning outright dismissal of charges isn’t realistic. But experienced lawyers have plenty of tricks to secure the next best outcomes through alternative resolutions.

For first-time offenders, diversion programs offer a path to avoid conviction altogether. These involve completing rehab, counseling, or community service in exchange for charges eventually getting dropped if you stay out of trouble.

If diversion isn’t on the table, pleading to reduced charges in exchange for a lighter sentence is common. I’ve had numerous cases where prosecutors agreed to knock felonies down to misdemeanors to secure easy plea deal convictions.

And even if charges stand, skilled lawyering can lead judges to go extremely easy on sentencing compared to the max penalties allowed by law. I convince them to hand down probation or home monitoring instead of jail time whenever possible.

The key is having an assertive advocate who knows which buttons to push and how to work the system. Public defenders are overworked, and most lawyers just want to take your money for quick plea deals. I actually fight for your best interests in the courtroom.
