Sued by Kapitus: 7 Things That Happen Next
Read the caption before you read the allegations. Which court, which county, and who accepted service will shape the cost of this case more than any paragraph in the complaint. Then find the venue clause in your agreement and see whether the two match.

A sued-by-Kapitus letter feels like a shot across the bow, but it actually launches a 20- to 30-day countdown clock. Kapitus still needs to prove its case, every step of the way. Ignoring the papers really could mean a default judgment, added interest, even frozen bank accounts. But real defenses exist. Here are seven things that actually happen when you get sued by Kapitus, in order.
1. Watch the deadline
The most important thing to do when you’re served in New York? Track the date the summons was delivered. That means looking at both when the process server or sheriff put it into your hand, or if you weren’t served directly, the date service was completed. Once you know which date applies, add 20 days from it if they handed it to you, or 30 if they didn’t - that’s your deadline to respond. Calendar the answer deadline. Do not default! It really can happen.
2. Service gets tested
The lender still has to prove the summons got to you properly. A process server’s description that sounds a little vague, or shaky service on someone who’s outside New York State, can lead to a denied default judgment and a 60-day refiling window for Kapitus. If either party wants more detail on the service, they can ask for “a traverse hearing” to look into what really happened.
In one case, a New York process server had no record of the documents he handed a man he said he recalled because the man spoke “broken” English, even though the defendant did not. The court threw out the service. If your server has no paperwork, or admits they weren’t exactly sure who they were dealing with, the judge can throw it out.
3. Default is not automatic
Kapitus filing a request for default judgment does not mean they have already won the case. They will have to prove their entire case to win. In a case involving a personal guarantor, bounced ACH debits weren’t enough to prove a breach. Kapitus still has to prove it sued within the six-year deadline the law gives for contract disputes. If Kapitus waited too long, its case may be dismissed as untimely.
4. A judgment gets expensive
A default, or a win, will lead to a money judgment for Kapitus. And it brings 9% yearly interest. Kapitus can also use the judgment to freeze your bank accounts for 52 weeks, up to twice what you owe in total. Both are serious moves, and can leave you shut out of your money.
Even after a default judgment, it is possible to get the case back by making a motion to reopen the case. The best chances come if you have both a decent reason for missing the deadline and a legitimate defense that could beat the case if it moves forward. Many courts will give you a second chance within a year of being served with the judgment and notice of entry.

5. Standing gets questioned
If someone is suing to collect a debt, a key question is whether they have the legal right to be in court. Kapitus generally can sue if its name is on the contract. But if another company’s name is on the paperwork and a related company is trying to sue in its own name, that kind of suit needs more legal proof it has a right to collect. Colonial Funding (now known as Kapitus) won a default when it did not actually appear on the merchant agreement. When the defendant tried to reopen, the court threw out the default because he had an excuse and a possible defense: Colonial was not a party to the contract.
6. New York and more defendants
If you agreed in writing to let Kapitus sue you in New York State, they will probably be able to do so. A forum selection clause is generally enforced. And a clause in an agreement that says lawsuits may only be filed in New York might bind your business partners, even if they never signed on to that particular deal. Agreeing in writing to let the creditor sue you in New York court generally waives your right to complain the venue is inconvenient for you.
7. Discovery, then the real fight
If you answer and deny the debt or some key claim, this brings more work. One important step is discovery: information traded among the lawyers to prove their cases. Each side will want to see financial and business records. The lender may ask to interview you under oath, a step called a deposition. You can expect Kapitus to ask for financial documents dating back years, and even from after the contract ended.
In the real fight, a large question in many of these cases is whether the money you took actually counts as a loan. In October 2025, a New York appeals court let a $103,500 usury defense against Kapitus stay alive. The court said a collect-in-bankruptcy clause and an all-assets security interest plus a guaranty looked like a loan, not a purchase. The courts are interested in whether there is a reconciliation clause, an end date and whether the funder could collect if the borrower goes bankrupt.
Getting sued in New York, by Kapitus or anyone else, isn’t the end. Mark the deadline by which you have to respond. Then look at service, standing, proof of breach of contract and usury.
