As a business owner in Los Angeles, you know that working capital can often mean the difference between closing up shop or expanding your market share. Merchant cash advances seem legitimate at first glance. A lender looking to profit off your business need usually ties incredibly high daily payments to this option, and MCA companies purposely disguise that this product has a repayment structure that is not affordable.

How a Merchant Cash Advance Works

A merchant cash advance is a fast way for a business to get a cash infusion to increase operations, product volume, or move into new markets. With high approval rates and fast turnaround times, business owners can easily access thousands of dollars with few requirements. Often, all that is needed is a credit score at a minimum of 600, minimal defaults, and several months of credit card sales statements that can prove repayment ability.

In return for the funds, businesses pay daily or weekly through fixed percentage amounts deducted from every credit or debit card transaction. If your organization doesn't use cards for a large portion of its customer base, there are "lockbox" advances where repayments are made with direct payments.

This is not a small business loan, because there isn't a set payment date. As your revenues grow, your advance provider will get paid faster. Even though there are only a few qualifying requirements, repayment amounts are unpredictable due to the payment percentage calculated off of sales.

The Personal Guarantee

Personal guarantees often make small business owners believe they are getting unsecured business funding when this isn't really true. The guarantee usually gets secured in advance, before the cash gets sent - an agreement to let the lender collect from any of your assets or property in case you default. Although there's no collateral at the time you sign, many states, including California, enforce them if you ever fall behind on payments. Creditors can come after virtually anything of value, including bank accounts and real estate.

What Happens When You Fall Behind

When you miss a daily payment, merchant cash advance lenders waste little time filing a lawsuit to recoup their losses. The negative effects can often come within hours of you having problems meeting repayment obligations. An advance lender's suit usually involves a breach of contract, leading to the freezing of business bank accounts. Your financial institution can even get pressured by your MCA lender to freeze your accounts. Worse, an empty account will get charged an NSF fee from your bank and daily "liquidated damages" from your cash advance lender. If your accounts get frozen and you continue not to pay, they'll begin seizing inventory and other assets.

Judgments for liquidated damages often total thousands of dollars more than initially borrowed. You might owe interest at rates as high as 45% - 50% if you miss a payment or take an unauthorized withdrawal from your account. For businesses that don't pay off the full amount borrowed, some creditors will send another collection agent to try and recover these funds through yet another collection suit. A breach of contract case could get opened to penalize you further for any other damages the advance lender experienced due to your delinquent payments.

Confession of judgment clauses can significantly increase the money you owe when you fall behind. With a lawyer at your side, you may be able to fight this provision in court, and even settle for less than the original sum your creditor claims is owed.

Getting Help

Creditors often employ aggressive and sometimes illegal strategies that an experienced legal team can quickly mitigate. Once your advance lender finds out you're working with experienced counsel, your business has a much better chance of saving its assets and not paying the original full amount.

Not every lender wants to settle for pennies on the dollar. Their willingness depends upon how much risk and evidence gets found during an initial investigation: forensic auditing your cash advance documents for accuracy and contractual violations, negotiating to restructure your repayment agreement with terms you can actually afford. Some companies require only one negotiation. Others, with multiple creditors or judgments, might need several rounds of talks. Negotiating with creditors can result in substantial discounts, often saving businesses over half their owed amounts. Before filing for bankruptcy, it is always best to explore other options.
