How a Las Vegas MCA file actually gets settled: the sequence, the numbers, and the paper at the end

A Las Vegas dental practice owed $65,000 across its advances and paid $29,250 to close them. Forty-five cents on the dollar, $35,750 off the balance. Nobody argued an interest rate to get there, because Nevada does not have one to argue.

What produced that number was sequence and evidence. This page is about the mechanics: which funder you deal with first, what the funder is doing on its side of the table, and the five things that have to appear in the release before you send money. Outcomes vary, and the figures below are a documented example rather than a promise.

Anatomy of a settlement: $65,000 down to $29,250

Start with what the funder is actually holding. Not a $65,000 loan. A purchased receivables position with a daily draw, a blanket UCC-1, a personal guarantee, and a reconciliation paragraph it has probably not honored. Each of those four is a separate item in the negotiation.

The dental file closed at 45 cents because two facts sat on the table together: months of daily debits taken while collections were plainly down, and a written reconciliation request the funder never answered. That combination changes what the funder is pricing. It stops pricing your balance and starts pricing the cost of explaining its own paragraph.

The wider Las Vegas market runs a little softer, near 50 cents on an average advance around $21,000, and closes in about four months. Files that beat the average are the ones where the correspondence exists. Files that fall short are usually the ones where nobody asked for reconciliation in writing before the default.

Which funder you settle first, and why the order sets the price

Stacked files are not negotiated all at once. Funders in this market watch each other, and the first number accepted becomes the reference for everyone behind it. Settle the easiest one first at a weak discount and you have just published your ceiling.

Order by leverage. The funder whose reconciliation record is worst goes first, because the evidence is strongest there and the number sets the floor for the rest. The funder holding the filed UCC-1 and running the loudest collection campaign usually comes next, because a concrete termination is what buys operational quiet. The smallest balance goes last, since it is cheap to close and nobody should spend leverage on it.

Two practical rules run through all of it. Never take a new advance to fund a settlement, which is how a two-funder file becomes a five-funder file. And do not let a funder push you into a payment plan dressed as a settlement, where a single late payment reinstates the entire original balance.

The Las Vegas revenue calendar the funder priced wrong

Restaurants and food service make up 39 percent of MCA borrowers in this market, trucking and transport 18 percent, healthcare 13 percent, salons 10 percent. Those are not businesses with smooth deposits. They are businesses whose deposits follow a convention calendar, a construction schedule and a tourist season.

The underwriting behind most advances took a few months of bank statements and extrapolated a flat line. A daily fixed draw then assumes that line holds. When a slow stretch arrives, the draw does not shrink with the receipts, so the percentage of revenue the funder takes climbs exactly when you can least afford it.

That mismatch is not a sob story, it is the evidence. Deposit records showing the draw rising as a share of revenue are what make a reconciliation request reasonable and a refusal look deliberate. Pull twelve months, not three, and put the two lines next to each other.

What the funder is doing on its side of the table

A funder's collections desk is not deciding whether you are sympathetic. It is deciding what this file is worth if it goes to litigation, what it is worth sold to a debt buyer, and how long it will take.

Three things push its number down. Evidence it breached its own reconciliation clause. A real question about whether it is engaged in the business of lending in Nevada without a license under NRS 675.060, which NRS 675.070 extends to anyone evading the requirement by any device, subterfuge or pretense. And a merchant clearly willing to defend rather than disappear.

One thing pushes its number up: silence. A file that goes quiet for six weeks gets recategorized as collectible by pressure, and pressure in this market means calls to your customers and a UCC-1 waved at your bank. Answer every contact in writing, log the date and the name, and keep the tone flat.

The release, the lien and the ACH authorization

Five clauses. A Las Vegas settlement missing any of them is not finished.

  1. The payoff figure and payment dates in full, with no acceleration or reinstatement clause surviving.
  2. A release of the operating entity and of every guarantor named individually.
  3. An express commitment to terminate the UCC-1, by filing number, with a stated deadline.
  4. Termination of the ACH authorization effective on the final payment, in writing.
  5. A commitment not to sell, report or place the balance, and to recall anything already with a collector.

Then send a separate signed demand for the termination. NRS 104.9513(3) gives the secured party 20 days from that signed demand to file or send the termination statement where no obligation remains, and NRS 104.9625(2) and (3) put a damages number on a failure, including the cost of being unable to obtain alternative financing.

Four moves that cost Las Vegas owners real money

Each of these is common, and each one is expensive in a measurable way.

  • Paying a settlement before the release is signed. Once the money moves, the guarantor release stops being negotiable.
  • Closing the debited account without advice. It is read as breach and it accelerates the balance you were about to discount.
  • Taking a renewal or top-up to buy time. The new advance pays off the old one at full price and restarts the draw on a larger number.
  • Letting the lien sit after payment. Nevada leaves a terminated financing statement visible in the system for a year after it lapses under NAC 104.255(2), so the release and the termination filing have to travel together to your next lender.

None of them are about willpower. They are about doing steps in the right order, which is the entire argument for having someone who has run the sequence before run it again on your file.
