Larceny – also known as theft – is basically when someone takes someone else’s property without permission. There’s a bunch of different types of larceny charges here in Washington State. The main things that determine what type of theft you get charged with are 1) how much the stuff you took is worth, and 2) if you used force or weapons when taking it.

Misdemeanor Petty Theft

If you steal stuff that’s worth $750 or less, you can be charged with misdemeanor petty theft, aka theft in the third degree[3]. This is basically shoplifting – taking stuff from a store without paying. Misdemeanor petty theft is the lowest level theft charge.

It’s still a criminal charge though, so you can face:

  • Up to 364 days in jail
  • Up to a $5,000 fine

Some common defenses here are:

Felony Theft

If you steal stuff worth more than $750, it becomes a felony theft charge. There’s two levels of felony theft:

  • Up to 5 years in prison
  • Up to a $10,000 fine

Theft in the First Degree

  • Stuff worth more than $5,000
  • A firearm, no matter the value
  • A motor vehicle, no matter the value
  • Stuff directly off someone’s body, no matter the value

Theft in the first degree is a Class B felony[4]. You can get:

  • Up to 10 years in prison
  • Up to a $20,000 fine

Yikes! As you can see, the penalties get pretty harsh if you steal valuable stuff.
