What Happens if One Funder Refuses to Settle?

After you file a mass tort claim on behalf of your funder clients, there is a chance that some may want to settle while others do not. Filing a mass tort lawsuit does not necessarily mean that all of the claimants you represent will be able to agree on a settlement. We often see scenarios in which some funders want to accept the defense's offer while others want to keep fighting.

If you are facing this scenario, do not attempt to resolve the matter on your own. Not only will the advice you receive from your funders often be flawed, but this advice will also serve the funders' interests rather than your clients' best interests. Your job is to represent your clients, and you must continue to do this when settlement talks have started. If some of your clients are getting cold feet while others are ready to resolve their claims and move on, it is up to you to serve as their guide. That means analyzing the risks and benefits of settling (and of not settling), communicating those risks and benefits to your clients, and offering advice that serves their best interests.

"He Said/She Said" Won't Help

If some of your funder clients are being advised by funders to reject settlement proposals that are clearly in their favor, you may be at risk for receiving conflicting settlement instructions. This is not a position in which you want to be. As plaintiff's counsel, it is your job to act on your client's behalf and in your client's best interests. Conflicting instructions make it very hard to do this successfully.

Even though the dispute is between the plaintiffs, the court won't care, and "he said/she said" arguments won't get you anywhere. You need to do everything you can to avoid this scenario if possible - and you need to start thinking about your options immediately. But be very careful here as well. Anything you say or do can, and will, be used against you if and when one of your clients pursues further legal action to avoid settling.
