Sued by High Speed Capital: 7 Things That Happen Next

The threshold question is whether the agreement is a purchase of receivables or a loan wearing a costume. Courts decide that by looking at reconciliation, contingency of repayment, fixed terms and how bankruptcy is treated. The answer reshapes every other item in the file.

If you were sued by High Speed Capital, recent events mean that your case is most likely over, and you owe nothing to High Speed Capital. High Speed Capital is one of the companies in the Yellowstone network. It is part of the New York Attorney General settlement with the Yellowstone companies that includes cancellation of $534 million of debt, and dismissal and vacating of pending merchant lawsuits. The settlement also means Yellowstone and its related companies cannot collect or sell the debt.

1. Confirm who funded you

It will be helpful to know if you were funded by a Yellowstone company, which means that the debt is covered by the New York Attorney General Settlement and subject to cancellation. To confirm this, look at your funding documents. Look on your bank statements to see if any of the Yellowstone companies are listed. You may not recognize the name of the funder. Yellowstone has used many company names that may appear in bank statements and elsewhere. A merchant funding company is not always the company that actually funded you.

2. The debt is canceled

As long as you were funded by a Yellowstone company or their related companies, your debt with Yellowstone is canceled. You do not owe any money to these companies. Your debt is canceled even if you have not heard from the Yellowstone companies. Sometimes you sign an individual guarantee promising to pay the funding company a certain amount even if the business fails or otherwise does not pay. If you signed a personal guarantee to get the merchant cash advance, that guarantee is also canceled as part of the Yellowstone settlement.

3. The lawsuit gets dismissed

If you have a pending lawsuit, the attorney general settlement requires Yellowstone to dismiss that lawsuit. Vacating is when a judgment in a court case is erased. Under the settlement, the final remaining pending judgments were vacated on December 18, 2025. This only applies to judgments that had not already been satisfied in full. Search the website of the New York Courts to see if you have a judgement and whether it has been vacated.

4. Some deadlines have passed

Claims for payment closed January 9, 2026. Payments were made only to merchants who claimed and paid Yellowstone more than they received. It is too late to make a claim or appeal an amount you received. If Yellowstone placed a lien against your property or equipment, Yellowstone agreed to file a termination of that lien if you request it. The final date to request termination of any liens was July 8, 2025.

5. If they still come after you

If Yellowstone or related companies do reach out to you and say that you owe them money, contact the New York Attorney General’s Office immediately. It is possible that Yellowstone or one of its related companies will continue its improper activities. This means you could get mailings or even court papers that tell you that you owe money. This is against the terms of the settlement. When you contact the New York Attorney General, make sure that you have your original funding documents, the names and phone numbers of the people you dealt with when signing up with your funder, and all other documents relating to the merchant funding cash advance. The settlement is between the attorney general’s office and the Yellowstone companies, and it does not affect your rights to get damages.

6. Cloudfund is a different story

The Yellowstone settlement did not include Cloudfund. In the settlement, Cloudfund is treated as separate from the Yellowstone companies and you are not entitled to the same benefits as described above. So Cloudfund did not have to dismiss a lawsuit against you and it does not have to cancel your debt. If you are facing a lawsuit from Delta Bridge Funding d/b/a Cloudfund, you can take steps to handle that lawsuit separately from the Yellowstone settlement. On March 4, 2026 a judge refused to dismiss the attorney general’s case against Delta Bridge, and is allowing the case to go on.

In a New York lawsuit like this one, you need to respond if you want to defend the lawsuit. You must answer the complaint within 20 or 30 days of being served with the summons, depending on how you were served. Also, in New York if you fail to answer a complaint within the time allowed, the court can enter a judgment against you because of this failure. This is called a default judgment. A judgment can also come from a confession of judgment, which is a pre-admission to having lost a lawsuit that has not yet happened. New York limits where you can file a case based on the confession of judgment. A confession of judgment can only be used where you lived when you signed it or where you currently live. A business lives wherever it has a place of business.

7. What a judgment would cost

A judgment against you would be a court order requiring you to pay Cloudfund the amount it says you owe. It could also award Cloudfund interest at the legal rate, which is 9% per year. If Cloudfund gets a judgment against you, it is allowed to collect that money in various ways. This includes freezing up to twice what you owe in your bank account through a restraining notice. A judgment is presumed paid only after 20 years, and any partial payment or written acknowledgment of the debt restarts that clock.

One possible defense in New York is criminal usury, which is knowingly charging more than 25% a year. If the rate was illegal, then the loan is void, so the lender recovers nothing. This defense may or may not work. It may be a good idea to talk to a lawyer about whether and how your property may be affected by this lawsuit.
