New Jersey Ignorance or Mistake Defense Law – 2C:2-4

New Jersey statute 2C:2-4 provides defendants with potential defenses in criminal cases based on ignorance or mistakes of fact or law. This allows defendants to argue they should not be held criminally liable for breaking the law if they were reasonably unaware their conduct was illegal, or made an honest and reasonable mistake regarding the facts of the situation.

Ignorance or Mistake of Fact

Under 2C:2-4(a), it can be a defense if the defendant made an honest and reasonable mistake regarding an important factual circumstance. For example, if someone takes property belonging to another person, but had a reasonable belief it was their own property, they may have a defense against theft charges. However, the mistake must be objectively reasonable based on the circumstances.

Ignorance or Mistake of Law

Section 2C:2-4(c) allows for a defense based on ignorance or mistake of law in limited cases. This applies when the defendant reasonably believed their conduct did not legally constitute an offense, after making reasonable efforts to determine the law. However, ignorance of the law is generally not an allowable defense.

Implications
