MDMA, also known as ecstasy or molly, is an illegal synthetic drug that is popular among young people and clubgoers for its energizing and mood-enhancing effects. However, possession and distribution of MDMA carries serious criminal penalties in most states. This article provides an overview of MDMA and the typical charges and penalties for possessing or distributing it.

What is MDMA?

MDMA stands for 3,4-methylenedioxymethamphetamine. It is classified as a Schedule I controlled substance, meaning it has a high potential for abuse and no recognized medical use. The drug produces feelings of euphoria, emotional warmth, empathy, and sensory enhancement. Effects typically last 3-6 hours. MDMA is commonly taken in pill or capsule form, with doses ranging from 60-120 mg. It is sometimes mixed with other drugs like methamphetamine or caffeine.

MDMA goes by many street names like “ecstasy,” “molly,” or “E.” It surged in popularity as a club drug in the 1990s and 2000s due to its energizing effects. More recently it has seen resurgence among high school and college students. An estimated 1 in 20 young adults have used it in the past year.

MDMA Possession Charges

Simple possession of any amount of MDMA is illegal. Possession laws vary by state but are generally felony offenses punishable by substantial fines and years in prison. For example:

  • In Texas, possession of less than 1 gram of MDMA carries up to 2 years in jail and a $10,000 fine.
  • Colorado classifies possession of any amount as a felony with 1-3 years in prison.
  • Nebraska sets penalties at up to 2 years in prison and a $10,000 fine.

Penalties increase with the weight of MDMA possessed, with some states setting mandatory minimums. Having MDMA near schools or parks can also lead to enhanced charges and penalties.

Charges for Selling or Distributing

Selling, distributing, or possessing MDMA with intent to sell or distribute also carries severe criminal penalties. Like possession, the charges and sentences depend on the state but can include:

  • In Texas, distributing any amount of MDMA is a felony with up to 2 years in jail. For 400g or more, there is a mandatory minimum of 5 years in prison.
  • New Jersey sets a range of 5-20 years in prison for distribution depending on quantity, with fines up to $500,000.
  • Colorado imposes 1-12 years for distribution of any amount. For 25g or more, prison time is mandatory.

Selling MDMA in or near schools and parks leads to further penalties in most states. Those caught distributing substantial quantities may also face federal trafficking charges.
