MCA debt relief in Tennessee: what a lawyer can do, what a settlement company cannot, and how to tell them apart

None of them can file anything on your behalf, and two of the three ranked on this page employ no attorneys at all.
That distinction is not a technicality in Tennessee. It is the whole file. The state closed the rate argument in 2006, which means what is left is contract work and motion practice: the true-sale question, the reconciliation clause, an out-of-state judgment arriving at a county clerk's office, and a Consumer Protection Act count with treble damages behind it. Every one of those is something a non-attorney is legally barred from doing for you.
Which of these companies is a law firm? None of them

Four Tennessee moves a settlement company cannot make
- Attacking a domesticated judgment. A funder that took a judgment elsewhere brings it here under Tenn. Code Ann. § 26-6-104, which makes it subject to the same proceedings for reopening, vacating or staying as a Tennessee judgment of record. Section 26-6-105(c) bars execution until 30 days after the summons is served. That is a motion, filed inside a window, by a lawyer.
- Pleading recharacterization. Arguing that a papered purchase of receivables is really a loan is a legal theory advanced in a pleading, not a talking point in a phone call.
- Running the § 47-14-117(c) remedy. On a finding of unconscionable conduct the creditor recovers no interest or charges at all, must refund the charges and twice the interest collected, and owes your attorneys' fees. Subsection (c)(2) defines unconscionable conduct to include a calculated violation of the statute.
- Bringing a Consumer Protection Act claim. Section 47-18-109(a)(1) opens the private right of action to any person with an ascertainable loss, and (a)(3) allows treble actual damages for a willful or knowing violation.
A settlement company can ask a funder for a discount and wait. It cannot tell a funder what happens if the contract is tested. That difference is why the ranking on this page looks the way it does.

If a firm opens with criminal usury, it is reading a New York script
Here is a free vetting test. Ask what the usury argument looks like in Tennessee. If the answer involves an effective APR crossing a criminal threshold, the firm is quoting a state you do not live in.
Tennessee never wrote that number. Section 47-14-112 is nine words: the willful collection of usury is a Class A misdemeanor. Usury just means interest above the applicable maximum effective rate, so the criminal line floats with the civil one instead of sitting at 25 percent the way New York's does.
And the civil ceiling has nothing to bite. In 2006 the General Assembly passed Public Chapter 565 and amended § 47-14-102 so that interest does not include any amount of a discount or fee in, or charged under, an account purchase transaction. A rate cap with nothing to measure is not a defense. A firm that does not know this about Tennessee will work your file from a template.
What a non-attorney settlement company is genuinely good for
This is not an argument that debt relief companies are useless. They are useful for a specific thing: volume negotiation on unsecured consumer accounts where the creditor's decision is made by a servicing algorithm rather than by a lawyer.

The failure mode is category confusion. An MCA is a commercial contract with a lien behind it and a guaranty under it. Enrolling it in a 24 to 48 month consumer escrow program means daily debits continue while your money accumulates in a savings account, and Tennessee's six-year contract limitation under § 28-3-109(a)(3) gives the funder plenty of time to sue you while you wait.
What attorney-founded means, and what it does not
It means the people who built the operation practiced law and the intake analysis reflects that. It does not create an attorney-client relationship, it does not carry privilege, and it does not put anyone in a Tennessee courtroom on your behalf.
Treat it as a quality signal about the analysis, not as legal representation. The honest version of the pitch says exactly that, and the companies on this page carry the disclaimer for a reason. Hour one: identify every funder by legal entity name, not by the abbreviation on the bank debit, and total the daily draw as a percentage of daily deposits. Above 15 percent, the business is being liquidated one morning at a time.

The choice-of-law provision, which under § 47-14-119 can be enforceable in Tennessee where the transaction bears a reasonable relationship to both states.
