When the funder stops calling and starts filing: Michigan judgment defense and the firms that can actually respond

The collection calls end abruptly. That is not relief. It usually means the funder handed the file to counsel, and the next document is a summons, a domesticated out-of-state judgment, or a writ of garnishment served on the bank that holds your operating account.

Michigan gives you specific clocks at that point. Twenty-one days before execution. One year on some grounds for relief and no deadline at all on another. Six years on the underlying contract claim. These are not the same rules New York runs on, and the firms advertising the loudest into this state are usually reciting New York.

Michigan permits a confession of judgment, then conditions it

Some states void the clause outright. Michigan does not. MCL 600.2906 lets a judgment be entered in any circuit court at any time on a plea of confession signed by an attorney of that court, with no suit pending. Then it attaches two conditions and closes with three words that matter: "and not otherwise."

First, the authority to confess must sit "in some proper instrument, distinct from that containing the bond, contract or other evidence of the demand for which such judgment was confessed." A warrant of attorney buried on page nine of the funding agreement is not a distinct instrument. Second, that authority must be produced to the officer signing the judgment and filed with the clerk at the time the judgment is filed and docketed.

So the first thing to check is not whether you signed one. It is whether the funder followed the statute. Pull the court file and see what was filed with the clerk on the day of entry.

When a New York judgment lands in a Michigan court

Most MCA paper is signed under a New York forum clause. The funder takes its judgment there, then files an authenticated copy with a Michigan circuit, district or municipal court clerk under MCL 691.1173.

Read what that statute actually does to it. A judgment filed under the act "has the same effect and is subject to the same procedures, defenses, and proceedings for reopening, vacating, or staying as a judgment of the circuit court, the district court, or a municipal court of this state." The funder chose to come here. Michigan's machinery now applies to its judgment.

That is the hook. The motion practice, the grounds for relief, and the stay of execution are all decided under Michigan rules, in front of a Michigan judge, on a record the funder assembled in another state expecting nobody to look.

The three clocks running against you

  1. 21 days. MCR 2.614(A)(1): execution may not issue and enforcement proceedings may not be taken until 21 days after entry of a final judgment. A timely motion for relief from judgment extends that bar until 21 days after the order deciding the motion. That is your window between entry and a garnishment on the operating account.
  2. One year. MCR 2.612(C)(2) requires a motion within a reasonable time, and for mistake or excusable neglect, newly discovered evidence, or fraud and misconduct of an adverse party, within one year of entry. Miss it and those three grounds are gone.
  3. No deadline. MCR 2.612(C)(1)(d) covers a judgment that is void. That ground carries only the reasonable time standard, not the one year cap. Where MCL 600.2906's conditions were not met, that is the subrule to be reading.

Note also MCR 2.612(C)(3), which preserves the court's independent power to set aside a judgment for fraud on the court. None of these are things a settlement negotiator can invoke. They are motions, filed by a lawyer, on a docket.

Why a pending motion changes the settlement number

A funder holding an unchallenged judgment has no reason to discount anything. It has a writ and your bank's address. Michigan files close near 45 cents on the dollar, and that discount is not generosity. It is priced off risk.

Put a motion under MCR 2.612(C)(1)(d) in front of the judgment and the funder's arithmetic changes. Enforcement is barred while the motion is pending. Its counsel bills by the hour. And if the judgment falls, the funder is back to litigating a contract it drafted, in a forum it did not choose, on the question of whether the advance was ever a purchase of receivables at all.

Funders settle to avoid that ruling. The settlement conversation and the motion are not alternatives. The motion is what makes the conversation worth having.

If nothing has been filed yet

Then you are in the better position and you should act like it. Send the reconciliation demand in writing and date it. Document every day the funder debited a fixed amount while deposits were down. That correspondence is what the file is built on later.

Check the calendar too. MCL 600.5807(9) gives a written contract claim six years from accrual, renumbered from subsection (8) by 2018 PA 15. On a balance from an advance taken in 2019, the funder's window is a live question rather than an academic one.

Which of these firms can respond to a filing

None of the three companies ranked on this page is a law firm, and that disclosure matters more here than on any other page in this series. A settlement company can call a funder. It cannot appear, cannot file, and cannot ask a Michigan judge for anything.
