Both will tell you they reduce merchant cash advance balances, and both are telling the truth. The gap between them only opens on the days that matter: the day a process server arrives, the day a funder freezes the account, the day someone has to say what happens next if the answer is no.
This page is not an argument that debt settlement companies are illegitimate. Two of the three firms ranked below are exactly that, and they resolve real balances. It is an argument that the two things are different products, and that most owners buy one while believing they bought the other.
One of them can file an answer to a summons. The other can call the funder
A funder suing an enrolled merchant is one of the most ordinary events in this business. It is also the event that separates the two products completely.
A summons carries a response deadline counted in days. Miss it and a default judgment enters on the funder's numbers, with the funder's fees and the funder's interest, and the next document you see is a restraining notice on your operating account. Nothing about a settlement negotiation pauses that clock. There is no automatic stay in a negotiation.
A licensed attorney files the answer, appears, and moves to vacate a judgment already entered. A settlement company can telephone the funder's collections desk and ask for time. That is the entire menu. Some are honest about it, and honesty here is worth paying attention to: we do not handle litigation, here is what you would need to arrange separately, here is roughly what it costs. That answer lets you price the gap.
Ask the question before you sign, not the week you are served. Get the name of the person who would appear.
What you tell one is privileged. What you tell the other can be subpoenaed
This one never comes up on a sales call and it should.
On an intake call you will be asked what your real revenue is, why the deposits fell, whether you moved the processing account, whether you took the fourth advance knowing the third was already impossible. Those are exactly the facts a funder's counsel wants, because several of them map onto fraud and misrepresentation clauses in the advance agreement.
Said to your lawyer, that conversation is privileged. Said to a settlement company, it is a business record held by a third party, and third party records are reachable by subpoena. The notes, the intake form, the emails, the recorded call. A merchant who candidly explained why the reconciliation numbers looked the way they did has handed a stranger a document.
It rarely matters. When it matters it is the whole file. Know which kind of conversation you are having before you have it.
There is a practical version of this too. Ask what happens to your documents and your file notes if the company is sold, closes, or is itself sued. A law firm has rules about that. A settlement company has a server.
One makes an argument about the contract. The other makes a request
Ask what is actually being said to the funder, because the two scripts are not close.
A settlement company's script is hardship. Revenue fell, the merchant cannot pay the full balance, here is what he can pay. It works when the funder would rather bank cash than spend a collections budget, and on plenty of files that is enough.
The other script is about the paper. A reconciliation request submitted with revenue documentation and never answered, which is a breach of the funder's own contract. A confession of judgment affidavit that omits what it is required to state. Servicing and default fees the agreement never authorized. A structure with no true reconciliation and no meaningful contingency, which reads as a loan wearing a costume rather than a purchase of receivables. Each one is a reason the funder's asserted balance is not the number a court would produce.
That is the mechanism behind 30 to 60 cents. Hardship asks. Defect argues.
One answers to a bar. The other answers to its own website
Commercial debt settlement is not a licensed profession. Anyone can open one, and in the years since the advance industry scaled, plenty did.
An attorney carries a bar number you can look up, a duty of loyalty that survives the engagement, trust account rules governing client money, a fee arbitration route if the bill is wrong, and malpractice coverage if the work is. Complaints go to a regulator with the power to suspend a licence.
A settlement company carries a Trustpilot page. Your recourse is a chargeback, a review and a complaint form. One Trustpilot reviewer described the failure mode plainly: a previous company took $13,000 and, two months later, had not contacted the creditors at all. Money real, fee real, nothing negotiated.
So do the check that substitutes for a licence. Read the one and two star reviews rather than the five star ones, search the exact legal entity in the CFPB complaint database, and require the fee basis in writing before anything moves.
Confirm the entity name matches the one on the agreement, not the one on the website. Trading names change faster than reputations do, and a company operating under a name younger than the reviews it advertises deserves a longer look.

The formulations to listen for are we have attorneys on retainer and we work with a network of lawyers. Both mean intermediary. You are paying a company fee and a lawyer fee, and the company's contribution to the outcome is an introduction to someone you did not choose.
Three questions settle it. Whose name is on the engagement letter. Is there a separate one with the lawyer. Who appears if I am sued, by name and bar number. Ask them by email.

Questions owners ask
Do I need an attorney to settle a merchant cash advance?
Not always. Plenty of advances settle through a negotiation on hardship terms. You need one when there is a lawsuit, an entered judgment, a confession of judgment, a frozen account, or a contract defect worth arguing. Those are the situations where a company without attorneys can do nothing at all on your behalf.
What happens if a funder sues me while I am enrolled in a settlement program?
If your provider is not a law firm, nothing happens on your side. The answer deadline runs and a default judgment can enter on the funder's figures, followed by a restraining notice on the operating account. Ask before signing who files the answer, whether it is included, and what it costs extra.
Is what I tell a debt settlement company confidential?
It is a business record held by a third party, which means it can be reached by subpoena. Attorney-client privilege does not attach. Be careful about what you volunteer regarding revenue reporting, processing account changes and why you took a later advance, since several of those map onto clauses in the agreement.
What arguments can a lawyer make that a negotiator cannot?
That a reconciliation request was properly submitted and ignored, which breaches the funder's own contract. That a confession of judgment affidavit omits what it must state. That servicing or default fees were never authorized. That the deal is a loan rather than a purchase of receivables. Each moves the number the funder can realistically assert.
