I’m Facing Charges for Reckless Driving in Nevada – What Should I Do?

Getting charged with reckless driving in Nevada can be scary. The penalties can be bad, including maybe jail time and fines up to $5,000 depending on the situation. As someone facing these charges, it’s important to understand the law and your choices so you can make the best decisions. This article will walk you through the basics of reckless driving charges in Nevada, possible penalties, and some tips on steps to take if you find yourself in this situation.

What is Reckless Driving in Nevada?

Nevada law says reckless driving is operating a vehicle “with willful or wanton disregard for the safety of persons or property.”[1] In simpler words, it means driving in a way that shows not caring about the safety of others on the road.

Some examples of reckless driving according to Nevada law[2][3] include:

  • Speeding a lot over the speed limit
  • Ignoring traffic lights and signs
  • Aggressive driving behaviors like weaving through traffic or cutting people off
  • Passing on the shoulder
  • Hitting medians or curbs
  • Driving the wrong way
  • Racing or drag racing
  • Driving when extremely sleepy

Basically any driving behavior that shows not caring about safety could maybe lead to a reckless driving charge. It goes beyond just making a mistake and is on purpose risky behaviors.

What are the Penalties for Reckless Driving in Nevada?

The penalties for reckless driving depend on the situation and if anyone got hurt or died. According to Nevada law[4], the possible penalties include:

  • For a first offense with no injuries: Up to 6 months in jail and/or fines of $250-$1000. More penalties for drag racing may include 50-100 hours community service and 6 month to 2 year license suspension.
  • For a second offense with no injuries: Up to 6 months in jail and/or fines of $1000-$1500. More penalties for drag racing may include 100-200 hours community service and 6 month to 2 year license suspension.
  • For a third offense with no injuries: Up to 6 months in jail and/or fines of $1500-$2000. More penalties for drag racing may include 200 hours community service and 6 month to 2 year license suspension.
  • If injuries or death happen: Felony charges, 1-6 years in prison, and fines of $2000-$5000. Penalties increase if it was in a school or work zone.

In addition to fines and jail time, a reckless driving conviction will also result in 8 points added to your driver’s license through the Nevada DMV. This is the highest points that can be given for a single violation.[5]

What Should I Do if I’m Facing Charges?

If you’ve been charged with reckless driving in Nevada, here are some tips on steps to take:

Get a Lawyer

The first thing you’ll want to do is get an experienced criminal defense lawyer, especially if facing felony charges. A reckless driving conviction can have long-lasting effects, so a lawyer is critical to help build the strongest defense and negotiate for reduced charges if appropriate. Make sure to be upfront about all details of the incident so they can best advise you.

Consider Your Defenses

There may be defenses that your lawyer can use to fight the charges, such as[6]:

  • You weren’t actually driving recklessly and the charges are false
  • There were circumstances out of your control, like swerving to avoid an accident
  • The officer made errors in the traffic stop or investigation
  • You were physically or mentally impaired at the time of driving

A skilled lawyer can review the details of your case to determine if any defenses may apply.

Negotiate for Plea Deals

Many reckless driving cases end up in plea bargains for reduced charges. A common option is pleading to a non-DUI reckless driving charge to avoid a DUI on your record. While still serious, a reckless driving conviction carries lower fines and penalties compared to DUI.

Take Driving Courses

Taking driving safety courses before your court date shows that you want to improve your driving skills. It shows responsibility and that you take the charges seriously.

Avoid Further Violations

Avoid any further driving violations before your court date. Additional charges will only make your case more difficult to fight. Limit driving to only essential trips.

Getting charged with reckless driving can be scary and overwhelming. But understanding Nevada laws, penalties, and your options will help you make the smartest choices. Consulting with an experienced criminal defense lawyer is highly recommended so you have an advocate on your side. With the right legal guidance, you can work to reduce the charges and penalties so you can move forward.
