Capital Advance Services LLC Demand Letter or Lawsuit? How to Tell the Difference
A demand letter cannot freeze an account, garnish anything, or force you into court. A filed complaint eventually can do all three. Confirm which one you have by checking for a court caption and a docket number, then respond to the document you actually received.

A demand letter asks the reader to pay, but there is no court case and no case number. A lawsuit is different: it comes as a summons and complaint that names a court, shows an index number and a deadline to respond.
Court-ordered Settlement
Capital Advance Services LLC is one of 25 companies owned by Yellowstone Capital LLC, which settled with New York’s attorney general. The court cancelled your balance when the suit settled January 16, 2025. Unpaid balances can not be collected or resold to others. Any personal guarantees are off the hook with the balances; no new legal action can come from this debt. If you had an earlier settlement agreement, its balance is now null. Yellowstone’s active lawsuits were dismissed.
The New York Attorney General’s office estimates that $534 million in merchant cash advance debts were discharged by the court-ordered settlement. The deadline to claim a refund was January 9, 2026. If you failed to file a claim on time you get no money, but your balance is still void.
There is one exception. A company called Delta Bridge Funding (doing business as “Cloudfund”) bought what remained of Yellowstone in May 2021. The Cloud contracts were out of the settlement. Check the letter for the name of the one who sent it. If the name was not part of the settlement, the problem may not go away until it is worked out. On March 4, 2026, the court refused to dismiss the Attorney General’s Delta Bridge case and it continues.
As long as it is still a letter and not filed at the court, there is still time to reach a deal that keeps it out of court. The rules on consumer debt collections do not protect against business debt demands. But a summons may never come after a demand letter.
A demand letter is a business letter, sometimes printed to look important. Do not ignore it, but on the other hand, it is not an order to pay. Take care on who the defendants are. You or the business? Both of you? Know who is sued to keep the damage down.
You may be alarmed when you get a notice that money has been frozen, or a notice to someone else to not pay the business’s money. Not every official-looking paper is something that says “do this or else.” Ask to see a copy of the notice or levy the bank or customer saw. That can start to fill in your picture of what happened. Find out who is sending the notices. Who says you owe the money? Whether it is enforceable can depend on who sent it. Do not move accounts or assets without advice.
When summoned to court, filing a defense is the job. The window to do it depends on where you live, how papers got served and when. New York law says that if you are handed the summons personally inside the state, you have 20 days to answer. If served in any other way, you get 30 days after the time of service. Federal courts are different in how they handle summonses. The usual timeline gives defendants 21 days from service, or 60 days if you waive service.
Save the envelope and email proof, make notes, and call a lawyer to get advice. Calling or writing the sender to ask for an extension or to say you don’t owe the money does not postpone anything. If you are served with a summons or complaint, you will need to appear and present a defense if you want to avoid a default judgment.
The funder or settlement agent likely did not file your defense for you and you need to ask a lawyer about appearing for you. Settling and defending are different jobs, so one agent may not do both. Check what you are signing, and who agreed to defend. Court papers for one person may not cover others, including the business.
You will want to give your lawyer the whole picture of what’s going on. They’ll look at how you got the summons, where the court has a hold on you, any arbitration clauses in the contracts and your personal guarantees. No matter how high a demanded balance is, the payback amounts, speed and tracking are key. These defenses are not “automatic” and must be filed with the court for a judge to hear and rule on. There is no “required” first step in a lawsuit. It depends on timing, facts and all else that is on the table. Dismissing a case is not automatic for being out of state. A judge must hear and decide it first.

Say the payments started falling short because the business took a dip. You can give what records you have to say what went wrong. The fact that a deal is called an “advance” or a “loan” may not carry much weight in a court case. Tell your story on what you did and how it was answered.
Before you sign a settlement deal, work out how much you are paying and what you get from the deal. Check for which of the entities will release the debt and the personal guarantee. It’s critical that the papers say what happens to the suit or judgment, or new lien filings or bank restraints. If payments are missed, what happens next?
A deal to lower payments may not lower the debt balance much, if at all. If one MCA has led to another, a deal with one of them will not take care of the others. Don’t mix the accounting records for different deals with different funders.
A confession of judgment (COJ) is a way to choose to lose to a lender, and it is only for use in the county where the loser lives. Since August 30, 2019, New York bans confession judgments from being filed against those outside the state. A confession of judgment might not have been legal where you signed it, or where the court filing went in. If you signed one, you might have reason to ask a lawyer to look at the papers and filing.
A judgment or lien found out of the blue may need to be fought. Find it by getting the papers from the clerk and then getting them to a lawyer. They can go over the facts and documents with you to see what happened. Filing a motion to vacate a judgment for “excusable default” under New York CPLR 5015 within one year after being served the notice of entry of judgment may help.
Make Sure Any Judgments and UCCs on Record Are Signed Off
If Capital Advance Services is on the paper, check that the debt really was settled and is no longer owed. The balance is void, but not every office may know it. Start by checking the New York Courts website to see if there is any court record. Judgments on Yellowstone’s books were cleared and vacated by court order in 28 counties. The last Yellowstone judgments owed were cancelled as of December 18, 2025. Where paid in full, the judgments stayed on the books but were noted as “satisfied.”
New York keeps a searchable UCC lien database on its Department of State site. A UCC lien (a recorded claim against a small business) was lifted in the settlement if you asked to have it lifted. Unless you asked by July 8, 2025, Yellowstone’s court order to end and release its UCC liens is not much use to you.
Most UCC financing statements are in effect for five years. If they have not been extended before the deadline, they are done. After that, the lien is no more, though the public record stays open for another year.
The Attorney General did not set up a late filer system, so anyone with a lien who did not make the filing date is on their own. By now, these old UCCs may have lapsed. Read the filing date on the UCC1 and see if it was filed more than five years ago.
A UCC3 amendment with the original file number can terminate and remove the UCC1 filing. The termination box has to be checked. A UCC3 on file that clears your name can be the best proof of cancellation. If you like, send a UCC5 filing to add a formal statement on the books saying the lien is finished. But this does not remove the lien.
You have the right to complain to the New York Attorney General that Yellowstone or its partners are still trying to collect. Look on its website and click on the link for complaints. The settlement keeps your right to sue on your own in the future.
