Business Advance Team LLC Demand Letter or Lawsuit? 6 Differences That Matter

Look for a court name, an index or docket number, and a summons page. If those are there, a case exists and a hard deadline is running. If they are not, you have a demand letter, which carries pressure but no court clock. The two situations call for very different responses.

A demand letter from Business Advance Team LLC is not a lawsuit, but it may be followed by a lawsuit. It’s a formal warning that a lawsuit may be filed if the debtor does not take appropriate steps.

1. Who makes the claim

This letter is received because the company making the claim alleges that a debt owed to them is in default. They make a demand that the debt is paid in order to avoid further action. They can make the claim against the business and any personal guarantor of the deal. A complaint in a lawsuit, by contrast, states all of the elements that the funder says it can prove. This letter will allege that a certain amount of debt is owed to this certain creditor. Remember, that figure is what they say is due at the time the demand is made.

2. The response clock

A demand letter may set any response deadline the writer chooses. There is no universal grace period for every MCA borrower, but the terms of the agreement do matter. Some contracts give a borrower a chance to cure a default. Some don’t. Check what the default, notice and cure provisions say.

A lawsuit has response deadlines set by law. In New York you have 20 days to appear if served in person, and 30 days if served some other way, such as leaving papers with a person or a nail and mail service. And if the papers were left with a person or nailed to a place, the 30 days don’t start until ten days after the proof of service is filed at the clerk’s office. Payment talks alone do not extend these deadlines.

3. Who can answer it

Any individual owner of a business can answer the demand letter. Generally speaking a bank statement with good records will show the payments made. A lawsuit changes this situation. A corporation sued in New York must appear by attorney, and the few exceptions are only in the lower civil courts.

4. What silence costs

Ignoring the demand letter doesn’t mean the debt just disappears. The claim can be followed by a lawsuit. Any questions on the amount claimed, or if the debt is legally collectible, are not determined at this point. And if you ignore a New York summons that demands a fixed-sum of money, then within a year after the default the plaintiff can ask the clerk to issue a default judgment against you. That judgment can be used to restrain your bank account or to levy upon things that you own.

Once a default judgment has been entered in a New York case, the defendant can try to get it undone for excusable default if it moves within one year after it is served with the judgment and notice of entry. The issue is complicated, you should take any motion to vacate you may be planning to an experienced attorney.

5. Faster court routes

Not every New York case starts with the filing of a complaint. One example is a suit on an instrument for the payment of money only. In that suit the plaintiff can give you a summons without a complaint. The motion for summary judgment (which starts the lawsuit) will be with the summons. The statement from the defendant which opposes the motion will be due by the date set in the notice of motion.

Sometimes the financial paperwork may include a signed confession of judgment. As long as the law allows the confession, then the funder may try to use the confession instead of filing a separate lawsuit. Some states limit or ban the use of this procedure. Check the file to see whether a confession was signed, and if so who signed it and whether it has been filed anywhere.

6. What protections apply

The federal law says that debt means consumer obligations only, not business or commercial debt. This means that most MCA borrowers are not covered by the protections in the federal Fair Debt Collection Practices Act.

In a 2024 lawsuit, the New York Attorney General said Business Advance Team LLC was a “subsidiary” of Yellowstone Capital LLC. As of January 22, 2025 the New York Attorney General has said that a total judgment has been entered in the sum of $1.065 billion against Yellowstone Capital and 25 companies that it had controlled. The companies will cancel $534,552,724 in small-business debts and end some liens.

Under the terms of the settlement Yellowstone and the other companies must mail instructions to every borrower who has a judgment or lien; that instruction letter must tell how to ask the companies to vacate any unsatisfied judgment or lien. The request to vacate has to be made within six months, so keep everything you get.

If court papers come, deal with court deadlines first. And have a qualified attorney check all deadlines. Time matters.
