Merchant cash advances are not like ordinary business loans. That is why banks generally do not offer them. To provide small and mid-sized businesses with "quick access to cash," merchant cash advance (MCA) companies purchase businesses' receivables and then claim a contractual right to a portion of their sales going forward. With short repayment periods - often between 6 and 18 months - and daily or weekly automatic debits, businesses that fall behind can quickly find themselves facing financial difficulties.

Forbearance Agreements

A forbearance agreement simply puts off payments and other obligations for a fixed period of time - it "buys" the business time to recover. If a business has legitimate defenses against an MCA, this can serve as leverage to enter into a forbearance agreement. If the MCA is unlawful or not permitted under state law, or if the MCA has illegally treated as a "true loan," then negotiating a forbearance agreement may be a strong first option to explore.

Out-of-Court Settlements

Negotiating an out-of-court settlement may be the best approach in your business's situation. Businesses will want a comprehensive settlement that does not expose them to additional future claims or new legal liabilities, and experienced attorneys can negotiate settlement terms with the necessary breadth and detail.
