Pawnee Leasing Corporation Business Debt Lawsuit: 5 Things to Do First
Pull the lease schedule and the acceptance certificate today, then calendar the answer deadline from the summons. An equipment lease is not a merchant cash advance. No receivables were sold and no reconciliation clause exists.

If Pawnee Leasing Corporation sued you for an equipment lease or loan, do not ignore it. It probably says it is seeking the balance on a loan or lease, but there may be more to it. Your first step is always the same, look for the time to answer. Next, find a lawyer for the business, and read the lease or loan document. Gather records to understand how they are calculating the unpaid balance, and which people may be responsible for it.
1. Find your deadline
The court papers will have a case number. Use it to look online and at the courthouse. Different places and cases have different response deadlines. In federal court, you usually have 21 days to respond after formal service. State courts vary. For example, in Colorado it is 35 days if you were served outside the state or via publication.
Missing the deadline can give the plaintiff an automatic win. With a default, you lose your chance to explain the case. In federal court, if the business never appears, the clerk can enter the judgment for the amount of the claim plus costs without a judge’s involvement. But this only works if the claim is for a fixed sum. The plaintiff must file an affidavit saying what the amount owed is. Understanding the deadline allows you to plan. Put that date in your calendar.
2. Get a lawyer for the business
The U.S. Supreme Court held that corporations can appear in federal court only through a licensed attorney. Lower courts apply the same rule to partnerships. Choosing a lawyer can be daunting. These cases can be highly technical. If your business is small, the lease may have both personal and business liability. This complexity makes it important to find the right lawyer to answer and defend the case. Look for lawyers who regularly handle this kind of claim.
3. Read the lease and your guarantee
To know your options, first figure out what type of debt it is, what its status is, and whether you signed a personal guarantee. Personal guarantees are common. Most banks won’t give an unsecured business loan without the owner’s guarantee unless the business has a long credit history. A personal guarantee means the lender may pursue the owner’s personal assets and sue both the owner and the company. In a small business, the two may be intertwined. Collecting from a guarantor may be easier than from a struggling business. Defaulting on the loan can mean negative credit reporting for the guarantor.
A secured loan has collateral, like equipment, inventory, or other assets. These loans tend to have lower interest rates, but you risk losing the collateral if you default. An unsecured creditor generally has to sue and win a judgment before they can go after your property or garnish your wages.
A finance lease under the Uniform Commercial Code (UCC) generally makes the business’s promises to pay irrevocable and independent once it accepts the equipment. It is very important to understand who signed the lease, what the lease requires, and how it describes the default. No matter how complicated, you need to understand it enough to answer.

4. Know what they can claim
If a lessor sues you for unpaid rent and you still have the equipment, they can recover the rent they’re owed up to the judgment, the present value of any remaining rent, and any incidental damages. They’ll have to deduct any expenses they saved, though. The UCC usually says a suit for lease default must be filed within 4 years after the claim arose. The original lease can shorten that to no less than one year, but you should still check the dates.
As for Pawnee itself, some time in April 2025, North Mill Equipment Finance reportedly bought nearly all Pawnee’s assets, including its lease portfolio. They planned to retire the Pawnee name. Yet suits in Pawnee’s name were still being filed in 2026.
The federal Fair Debt Collection Practices Act protects consumers from debt collectors, but it doesn’t apply to business debt collectors. You have fewer protections. Collectors can be aggressive.
5. Choose your path early
You will usually have two ways forward: settle the claim early or defend it. Early settlement can minimize the costs and risks of litigation. However, it is not always a good idea to settle. It is important to have the facts, and understand your options, before settling. Your lawyer should help you weigh the best choice at the outset.
How you handle the debt depends on your situation. You might settle for less than you owe, restructure the payments, or file bankruptcy to get out of the guaranty. Act sooner, not later. The worst consequences of missing deadlines can usually be avoided by being pro-active. For a struggling business, even a small financial slip can close its doors for good. Foreseeing problems is important, and finding ways to solve them can save the business.
