Bankers Health Care Group Filed Suit: 7 Questions to Answer Before You Respond

Question one is what your paper actually is, because a term loan and an advance are defended differently. A loan has a rate, a maturity and an amortization schedule. An advance buys receipts and lives or dies on reconciliation. Then check the response window, the exhibits, the guarantee and venue.

Fig. 02 · The article

If you’re reading this article, chances are you received legal documents from a company called Bankers Healthcare Group, LLC (“BHG”). They filed suit against you. You cannot ignore the lawsuit. I urge you not to respond to this suit without first knowing the answers to the following 7 questions. Keep in mind that it is up to the creditor to prove that the debt is actually yours and that you owe money on it.

1. Who is suing you

Bankers Healthcare Group (BHG) is a company that typically lends to medical professionals and small businesses. It rebranded itself as BHG Financial. Its subsidiaries include Fund-Ex Solutions Group and BHG Money. So even if you assumed your loan was with Bankers Healthcare Group, it might actually be with another company. Which one actually lent to you may have some bearing on your case.

2. Where and by when

What kind of court the suit is in and how long you have to answer the complaint are both extremely important. If the lawsuit is filed in New York’s Supreme Court, which hears cases over $25,000, you generally must respond within 20 days if you were served in person with the lawsuit and 30 days if the service was by another way like nail and mail. If you miss this deadline, the other side can get a judgment against you, essentially winning by default.

If the case is elsewhere, the deadlines may be different, depending on the court and service. In Florida, you also have to reply to the complaint within 20 days of service in state court. The answer deadline in federal court is usually 21 days.

3. Can that court hear it

Some debts are subject to a contract that limits where the lender can bring suit. A BHG note in a 2022 New York appeal chose Florida law and stated that suits could be filed in either Onondaga County, New York or Broward County, Florida. But that doesn’t mean the contract language is decisive.

New York courts are also picky about their jurisdiction for cases brought under contract. A contract would have to say that it was subject to New York law and have a minimum value of $1 million. Without that and if New York is not your residence, you can challenge that court’s authority to hear the case. A Maryland borrower faced this issue in September 2025. An Onondaga County court dismissed the case because New York’s choice of law standards were not satisfied.

4. Who is named

BHG may be suing you personally, your LLC or even both. As the owner, you may have signed a personal guaranty pledging that you would pay if the business defaulted, and that can hold you personally liable. Cases against you will typically raise claims of breach of contract or other ways to recover the money owed on the loan.

BHG or the collector can also bring claims that fall outside of a breach of contract claim. Two common ones are account stated, which argues that you received statements that were not disputed and are thus proof that you owe money, and unjust enrichment, which contends you kept money that you should not have had. Be very careful if your LLC or PLLC is sued. If the company is sued, it generally must have an attorney appear for it in court. Only individuals and sole proprietors can usually show up themselves to answer a complaint.

5. What does ignoring it cost

Failing to respond to a BHG or other lawsuit can be expensive. Default judgments permit the creditor to levy bank accounts, garnish wages and put liens on property. You may end up paying far more than your original loan, as judgments can include interest, fees and court costs. In some cases, the total can be double the original loan. A New York judgment on a business debt adds interest at 9% a year. Particularly if you are a professional, a judgment on your record can hinder your ability to renew a license. Keep in mind also that ignoring the lawsuit can hurt your credit score.

If you miss a deadline, you do have an opportunity to respond, but you generally must act quickly and show both that you have a valid reason for not complying and a defense to the underlying suit. Just not knowing what to do is not a winning excuse. A federal court in New York in 2020 refused to undo a default against a BHG borrower who showed up without a lawyer.

6. What do the documents show

Look closely at the documents BHG submits in court. It must show a valid contract or promissory note, demonstrate that it complied with it, prove that you breached it and detail the damages it incurred because of the breach. These legal documents are the foundation of its case. Sometimes, the papers may not be what they should be, and that is where you can focus your defense.

A class action accused BHG of disguising consumer loans as business loans to avoid consumer protections. So you may also want to be sure that your loan is a true business transaction. Also check the dates. The statute of limitations in New York is six years, and it is only five in Florida.

7. Can you settle

It is very possible that BHG’s attorneys will discuss a settlement with you, and a good deal can remove the uncertainty of how much you would have to pay. Settling is not admitting guilt. A good deal might include a reduced lump sum, interest-free payment plan or waiving attorney fees or court costs.

The bottom line is if you were sued by Bankers Healthcare Group, read the complaint carefully, figure out your response strategy and know your rights.
