MCA Debt Relief in Illinois: What State Law Permits
The substance of the transaction decides which law applies. An MCA that functions as a loan in Illinois answers to lending statutes that were not written for the funder's comfort, and the difference is worth money.

How We Scored the Field
Six factors shape the scores, weighted for the Illinois MCA market in particular. Commercial debt experience counts for more than consumer debt volume, because an advance secured by receivables and a personal guarantee behaves nothing like a credit card balance. Scores reflect data current through February 2026, and we revisit them when the data moves.
Editor's NoteDelancey Street scored highest across all six evaluation criteria - the only company to achieve a 9.5+ in every category.
MCA Activity Across Illinois
Figures reflect aggregated industry reporting for Illinois. Your numbers will differ.
Can you settle MCA debt in Illinois? Yes, you can, and the state puts few limits on what business funders can charge. If you hire someone to negotiate for you, they’ll need to be licensed by the state as a debt settlement firm under the Debt Settlement Consumer Protection Act. They can’t charge more than 15% of what they save you, and they have rules about what to do with your money.
Illinois Doesn’t Limit the APR Business Funders Can Charge
Unlike some states, Illinois doesn’t limit the APR business funders can charge on a business loan. The Interest Act caps interest rates at 9% on written contracts, but any rate at all for corporate loans, and that’s true too for sole proprietors and partnerships. That’s with exceptions for things like loans secured by household goods, or for the Predatory Loan Prevention Act. For non-bank financing like a merchant cash advance, you’ll need to do your own math on the APR, the law doesn’t make your funder tell you. The Small Business Financing Transparency Act would make them do it if the legislature passes it. As of January 2026, though, it hadn’t passed.
Even in a state as investor-friendly as Illinois, there’s still a couple laws that can help you if you’re getting pressured about paying your debt. Illinois voids a confession of judgment only in consumer contracts (personal, family, household), and only ones signed after September 24, 1979. Business loan contracts are outside these limits. Even so, a funder must file the confession in the county where you signed it, where you live or where you own property. If it’s filed in another Illinois county it won’t have any force. By contrast, in New York, the legislature barred confessions of judgment against non-residents as of August 30, 2019. The law defines a business as a resident only if it has a place of business in New York.
Federal regulators can also help: in a 2021 settlement, the Federal Trade Commission made Yellowstone Capital surrender $9,837,000 after charging it with unauthorized withdrawals and misstated financing amounts. When the FTC brings cases against abusive MCA funders, state laws and limits don’t stop it from reaching them.
Debt Settlement Consumer Protection Act
If you hire someone to negotiate your debt, you’ll want to make sure they do a good job of it. You also want to be confident they’re working for you, not with your creditors. The Illinois Debt Settlement Consumer Protection Act covers services paid to settle unsecured debt below the balance. A “consumer” for its purposes means anyone buying such services. The law makes it a Class 4 felony to practice debt settlement without a license. It also voids any contract you enter with an unlicensed debt settler. The law requires licensees to post a $100,000 bond, and practicing attorneys in Illinois are exempt.
As for what the debt settler can charge you, only an enrollment fee up to $50. The law makes the settlement fee payable only after settlement, and after the creditor receives payment. This fee is at most 15% of the amount saved from the original debt. Your savings sit in a trust account at a federally insured bank and stay yours. You keep control of your bank account as well.
Before they sign you up, the debt settler has to give you a written analysis of your financial situation. Next, a written estimate of how long their program will take you, in good faith. Then a written finding that you can afford the program. Your contract has to list all your creditors and debts and itemize all fees. It has to tell you how to cancel the program and have a cancellation form attached. You get monthly statements showing all the program’s activity.
The law makes the debt settler tell you:
- It’ll likely hurt your credit.
- Your creditors aren’t required to accept a settlement.
- You’ll get no protection from lawsuits or collections during the program.
Settlers can’t tell you to stop paying your creditors, that would violate the Act. The Act lets you cancel at any time. Within five business days they have to refund you any unearned fees and money not yet sent to creditors. The Act also forbids them from taking a confession of judgment from you, and makes the contracts void if they’re in violation.
Keep in mind that the Internal Revenue Service generally treats settled or cancelled debt as taxable income unless an exclusion applies, such as insolvency or bankruptcy (Form 982). The Bankruptcy Code also has a shortcut, Subchapter V of Chapter 11, for small businesses. The trade-off is that you can’t use it for more than $3,424,000 in debt, from April 1, 2025. H.R. 7730 passed the Senate September 28, 2026, to raise the limit to $7.5 million, and as of October 14 has not yet been presented to the President.
Protect Yourself
So, what should you do to protect yourself? The law’s strict rules on what the debt settler can do make it harder to get stuck with a bad contract. Besides that, you’ll want to investigate any service you’re thinking about hiring, even if it has to be licensed. To use a simple example, you’ll want to avoid anyone that makes you give up control over your account or your money, which the law forbids. Another thing to be careful of is to make sure you can afford a settlement program. Your debt settler has to give you all these disclosures and protections, and if they don’t, you should report it to the Illinois Attorney General’s Office and the Illinois Department of Financial & Professional Regulation. The Illinois Consumer Fraud Act calls these kinds of settlement violations unlawful practices, and lets you sue for damages.

FAQ: MCA Debt in Illinois
Are any of the companies on this page law firms?
No. Each of the three is a debt relief or debt settlement company that negotiates with funders on your behalf. Litigation, court appearances, and formal legal representation require a licensed attorney, and you should retain one for that work.
What share of an MCA balance do settlements usually reach?
Outcomes turn on the funder, the terms of the agreement, and the pressure available to your side. Settlements commonly land between 40% and 70% of the outstanding balance, and a business holding strong legal defenses tends to do better than the range suggests.
How long does an MCA settlement usually take?
Most files resolve within 3 to 9 months. The number of funders involved, the complexity of each agreement, and the temperature of the negotiation set the pace.
Can I revoke ACH access to my account?
Your bank will honor a revocation of ACH authorization. Do it as part of a plan rather than as a reflex, because a stopped payment with no strategy behind it tends to invite collection activity of the unpleasant kind. Professional guidance first is the sounder order of operations.
Does settling MCA debt touch my personal credit?
An MCA is a commercial transaction and ordinarily stays off a personal credit report. A signed personal guarantee changes the exposure, since a default can then reach you individually. A completed settlement resolves the obligation along with the liens that traveled with it.
How does MCA debt relief differ from bankruptcy?
Debt relief means negotiating each balance down with the funder while the business keeps operating. Bankruptcy is a court proceeding that can discharge or restructure debt, and it carries the cost, the public record, and the credit consequences that filing involves. Most owners who can settle prefer to settle.
